Agreement Between User and TagsForHope Inc.

The following terms and conditions (the “Terms”, “Agreement”) govern your use of this site (the “Site”) operated by TagsForHope Inc. (“we”, “us”, “our”) and the services (the “Services”) and products (the “Products”,”GoGoTag(s)”, “TagsForHope”) provided on or though the Site that are legally binding on you. If you do not agree with any of these terms, do not access or otherwise use or purchase the services and products offered on the Site. By clicking on the “Accept” button, or by using the Site and/or purchasing the Services and Products offered on the Site, it shall be deemed to be your agreement to abide by all of the terms and conditions set forth in this Agreement. By using the Site, you are also agreeing that you are over the age of 18 and therefore able to be legally bound under the these Terms.

1. Changes to these Terms and Conditions

These Terms and Conditions may be changed or updated at anytime without notice based on company and customer feedback and requirements. You are encouraged to review this Agreement with every purchase you make using the Services provided on the Site. It is your sole responsibility to be aware of these changes.

2. Disclaimers and Limitation of Liability

TagsForHope Products are novelty items that are customized by you for entertainment purposes only. We are not responsible for what you or anyone chooses to do with the TagsForHope Products. You may choose to use the TagsForHope pet ID tag novelty item as a pet identification tag as you are able to provide personal information about your pet. This way, if your pet gets lost, anyone who finds it will know the proper home to return it to. We are not responsible for what anyone who collects this information does with it. In other words, if your pet gets lost, and someone finds it and collects your information from the tag, you understand that we are not responsible for what that person does with this information. We are not responsible for the content which you customize the tag with, nor are we responsible for any issues arrising from incorect information provided on the tag which could potentially lead to, but is not limited to, the delay in returning your pet safely.

TagsForHope Products are not official identification items and are not affiliated nor recognized by any government or official licensing departments. TagsForHope Products are made solely as customizable novelty items. We may advertise that you can use the tag to replace all tags, but it is up to you to check with your local laws weather using our tag is sufficient or if you must use the tags provided by your local authority.

To make sure that this novelty item cannot be used in any illegal or unlawful way, we will not accept any human pictures to be uploaded and consequently printed on our Products. Therefore, if a picture of a human is uploaded, we will promptly cancel the order and refund you. We will only accept the pictures of pets that do not include any humans in them.

Furthermore, TagsForHope reserves the right and full discretion to cancel and refund any orders for any reason including, but not limited to the use of offensive or discriminatory language, inappropriate content, and offensive or discriminatory imagery.

If you choose to attach the tag to your pet’s collar, it is your responsibility to make sure that the tag is out of your pets reach and cannot be chewed by your pet. It is your responsibility to make sure that your pet does not eat, chew, or choke on the tag. We are not responsible for any damages caused by the tags to any person, animal, or property.

TagsForHope Products cannot be used as official nor legal registration or certification for service or therapy animals and are not recognized by the ADA or DOJ nor any other official government organization of any country. If you need official and legal certification for a comfort, emotion, therapy or service animal please contact the appropriate local government body in your area.

The TagsForHope Pet Passport product is not an official travel or identification document and does not certify the identity or nationality of any human or animal under any circumstance. It’s sole purpose is a novelty item that can be used to record a pet’s information such as, but not limited to, veterinary visits notes, vaccination history and microchip numbers.

TagsforHope is not responsible for how you choose to use our bandanas, collars, harnesses, leashes, and other webbing-based products. You are responsible to care for the products you purchase from us, and to check the product before use for any damages that may result in harm to your pet or any person. If you find the product to be damaged in a way that may lead to harm, you are responsible to cease the use of the product immediately.

You agree to defend, indemnify and hold us harmless and in no case shall TagsForHope, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, expenses (including but not limited to attorney’s fees), whether based in contract, tort (including negligence), strict liability or otherwise, arising from (i) your use of and access to any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility; (ii) your violation of any term of this Agreement; (iii) your violation of any applicable law, rule or regulation; (v) or any claim or damages that arise as a result of purchasing and/or using our Products and Services. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

3. Warranty

It is very important to us that we provide you with a product that is of the highest quality on the market. Therefore, upon purchasing a TagsForHope Product, we will provide you with a Life-Time Manufacturer’s Warranty. This means that if your Product is defected or damaged under the limitations set in this section of this Agreement, we will send you a new Product. We guarantee to uphold the TagsForHope Life-Time Warranty only while TagsForHope Inc. is in business and able to provide this service.

Your TagsForHope Product warranty is covered under the following conditions and limitations if:

Your TagsForHope Product warranty is NOT covered if (i) you have damaged it on purpose in manners such as, but not limited to, cutting it with anything sharp, snapping it, tearing or purposefully putting the Product under extreme conditions or (ii) if you receive a full refund for your Product.

In order to process your warranty, visit our warranty center and submit a warranty claim.

The TagsForHope Product warranty includes the following:

We are constantly revising and improving our products in order to deliver the best possible products. Once we make a change to any of our products, we can not revert back to a previous version. Therefore for example, when receiving a replacement tag under warranty, it is possible that you may receive a different and newer version of the product then the original one that you ordered.

4. Return Policy

Returning Tags, Wallet Cards, and Passports

Upon purchasing a TagsForHope Tag, Wallet Card, or Passport, you will be eligible for a 30-day full refund from the delivery date. If within 30-days you are unhappy with your product, please contact us. To receive your refund, you will have to send us the product. Once we receive the product, we will refund you the entire sum of your product.

Returning all other Products other than the Tags, Wallet Cards, and Passports

We will accept returns within 30-days of your delivery. Returns must be undamaged, unworn, unwashed, unaltered, and scent free in order to be returned for a full refund. A couple of things to note: some items purchased with our promotional sales are non-refundable. While some are only valid for size exchanges only, others can not be returned at all – reach out to our customer support team for more info on this.

Some items and designs may be discontinued, in which case we would not be able to accept a return or exchange. Items that have been further customized by us through your explicit request are final sale and cannot be returned or exchanged unless we make an exception. Please reach out to our customer support team for more info on this.

Damaged Returns

Every product we sell is custom-made to order, so if the returned item is deemed to be damaged, worn, washed, altered, or scented, we reserve the right to refuse your return and you will have to pay for the shipping to receive it back.

5. Use of Twemoji on our site

TagsForHope Inc. uses the Twitter Emoji (Twemoji) for all of the emojis on our products.

6. Mobile Message Service Terms and Conditions

The TagsforHope mobile message service (the “Service”) is operated by TagsforHope Inc. (“ TagsforHope ” , “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to TagsforHope’s SMS/text messaging service, you agree to receive recurring SMS/text messages with service-related and promotional messages, including updates, alerts, and information (e.g., order updates, account alerts, etc.) and promotions, specials, and other marketing offers (e.g., cart reminders) from and on behalf of TagsforHope via text messages through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with TagsforHope. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Standard message and data rates may apply from your wireless provider. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +1 (855) 854-7540. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other TagsforHope mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
