1. AGREEMENT TO TERMS

These Terms of Service (the “Terms” or “Agreement”) constitute a legally binding agreement between you (“you,” “user,” or “customer”) and TagsForHope Inc. (“TagsForHope,” “we,” “us,” or “our”), a corporation based in St. Thomas, Ontario, Canada.

By accessing our website (tagsforhope.com), purchasing our products, or using our services, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. ELIGIBILITY & AUTHORITY

By using our Site, you represent and warrant that you are at least the age of majority in your state or province of residence. If you are using our Services on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

3. “NOVELTY USE” & PROHIBITED CONDUCT (CRITICAL)

3.1 NOVELTY DISCLAIMER: You expressly acknowledge that TagsForHope Products are sold acting exclusively as novelty items, personal amusement products, and decorative accessories. They are NOT government-issued identification documents. They do not confer any legal rights, privileges, or access permissions (including ADA public access) to any animal.

3.2 WARNING REGARDING SERVICE ANIMAL FRAUD:

LEGAL NOTICE: In many jurisdictions (including but not limited to California Penal Code § 365.7, Florida Statute § 413.08, and various Canadian provincial statutes), it is a crime to knowingly and fraudulently misrepresent an animal as a Service Animal, Guide Dog, or Signal Dog.

You covenant and agree that you will NOT use TagsForHope Products to facilitate such misrepresentation. You agree that you will not customize our products with text, logos, or seals intended to deceive third parties into believing an animal has official government status if it does not.

3.3 USER REPRESENTATIONS: By submitting an order, you represent and warrant that the text and information you provide for customization is truthful and not intended to commit fraud. TagsForHope relies entirely on your representation and does not manually verify the legal status of any animal.

3.4 RIGHT TO REFUSE: We reserve the absolute right to cancel any order (without refund of customization fees, where permitted by law) if we suspect the design is intended to violate the law or facilitate fraud.

6.1 Incorporation of Warranty Policy: All products sold by TagsForHope are subject to our official Warranty & Returns Policy. By purchasing a product, you agree to the terms, conditions, and limitations outlined on our dedicated Warranty Page.

6.2 Summary of Coverage: As detailed in the policy linked above, our tags generally carry a Lifetime Manufacturing Warranty, while other products carry a limited 1-year warranty against defects. Lost, stolen, or chewed items are not covered.

6.3 Refunds: Refunds and exchanges are processed in accordance with the timelines (typically 30 days) and conditions specified in the Warranty & Returns Policy.

7. USER GENERATED CONTENT (UGC)

You may upload photos (“User Content”) to customize your products.

8. MARKETING & MESSAGING (EMAIL & SMS)

8.1 Email Marketing & Abandoned Carts: By providing your email address at checkout, you acknowledge that TagsForHope may send you commercial electronic messages, including order updates, newsletters, and abandoned cart reminders. For Canadian residents, we rely on “Implied Consent” arising from your existing business relationship (entering into a transaction) with us. You may unsubscribe from marketing emails at any time via the link in the footer of the email.

8.2 Mobile Messaging (SMS) Program: If you opt-in to our SMS program (e.g., via a checkbox or keyword), you agree to receive recurring automated marketing messages, including shopping cart reminders, at the phone number provided.

8.3 Duty to Notify & Indemnify (Recycled Numbers): If you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt-Out process prior to ending your use of the mobile telephone number. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD US HARMLESS from any claim or liability resulting from your failure to notify us of a change in the information you have provided.

8.4 State Law & Residency: To the extent you are a resident of a state with specific telemarketing laws (including but not limited to Florida, Oklahoma, and Washington), you agree that we may assume you are a resident of the state associated with the area code of your phone number. You agree that any mobile messages sent by Us in direct response to your requests (including but not limited to Keywords, opt-in, help or stop requests, and shipping notifications) shall not constitute a “telephonic sales call” or “commercial telephone solicitation” for purposes of these state laws.

9. INTELLECTUAL PROPERTY RIGHTS

10. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

10.1 “AS IS”: EXCEPT AS EXPRESSLY PROVIDED IN THE WARRANTY SECTION, THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

10.2 LIMITATION: IN NO CASE SHALL TAGSFORHOPE INC., ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS), ARISING FROM YOUR USE OF ANY SERVICE OR PRODUCT, INCLUDING BUT NOT LIMITED TO ANY CLAIMS RELATED TO SERVICE ANIMAL MISREPRESENTATION.

10.3 CAP ON LIABILITY: OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT.

11. DISPUTE RESOLUTION (FOR US RESIDENTS ONLY)

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR RIGHTS.

11.1 Mandatory Informal Dispute Resolution (The “Cooling Off” Period):

Before you are legally allowed to file a lawsuit or arbitration claim against TagsForHope, you agree to first participate in a “good faith” negotiation. You must send a written notice of your dispute to [email protected] including your name, order number, and a description of your issue.

For a period of sixty (60) days from our receipt of your notice, both you and TagsForHope agree to negotiate in good faith to resolve the dispute informally. You agree that this 60-day period is a condition precedent—meaning you cannot file a case until this time has passed. The statute of limitations shall be paused (tolled) during this period.

11.2 Binding Arbitration:

If we cannot resolve the dispute during the 60-day period, any remaining dispute or claim relating in any way to your use of TagsForHope services or products will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act applies to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

11.3 Class Action Waiver:

WE EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

11.4 Mass Arbitration Protocol (“Bellwether” Trials):

To prevent abusive litigation tactics, if 25 or more demands for arbitration are filed against TagsForHope by the same or coordinated counsel (a “Mass Filing”), you agree to the following rules:

  1. The AAA Mass Arbitration Supplementary Rules will apply.
  2. Bellwether Process: Ten (10) cases will be chosen to proceed first (5 chosen by you/your counsel, 5 chosen by us). These cases will be arbitrated individually while all other cases are stayed (paused).
  3. The outcome of these 10 cases will serve as a benchmark to mediate the remaining claims.
  4. You agree that this process is designed to ensure efficient resolution and is not a denial of your right to arbitrate.

12. DISPUTE RESOLUTION (FOR CANADIAN & INTERNATIONAL RESIDENTS)

12.1 Venue: If you reside in Canada or outside of the United States, this Agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein. You hereby consent to the exclusive jurisdiction and venue of the courts in London, Ontario, Canada in all disputes arising out of or relating to the use of the Site.

12.2 Consumer Protection: Nothing in these Terms shall deprive you of the protection afforded to you by the mandatory provisions of the consumer protection laws in your country or province of residence (including the Ontario Consumer Protection Act, 2023).
